This Privacy Policy is prepared in accordance with the Privacy Act 1988, the Australian Privacy Principles, the Health Records Act 2001 (Vic), the Spam Act 2003 and the Do Not Call Register Act 2006.

Consent: Where you submit a form on our website, we will ask you to actively confirm you have read and accept this Privacy Policy before your submission is processed. Continuing to browse our website does not, by itself, constitute consent to any collection beyond standard website analytics described in section 9.

We may collect personal information when you submit an enquiry form, download a resource or lead magnet, book a call or appointment, subscribe to updates, contact us by email, phone, LinkedIn or another channel, engage us to provide services, or attend one of our workshops, sessions or programs.

The personal information we may collect includes name, email address and phone number; organisation name, position or role and location; provider type and approximate organisation size; area of interest or concern; information provided in enquiry forms or messages; booking details and communication history; workshop or program attendance details; feedback or survey responses.

We may also collect limited technical information through the website, such as IP address, browser type, device information and website usage data, depending on the website tools, analytics or cookies enabled.

3. Sensitive information and health information

We do not intentionally collect sensitive personal information through our website unless you choose to provide it, or unless it is necessary for the service we are providing. Sensitive information may include information about health, disability, care needs, cultural background, professional memberships or other sensitive matters.

Please avoid including sensitive client, participant, employee or patient information in website forms unless it is necessary for your enquiry.

Where we collect sensitive information, we will only do so with your consent, or as otherwise permitted by the Privacy Act, and we will use it only for the purpose for which it was provided.

Health information

Sangasure delivers workforce capability and audit readiness services to aged care and disability service providers. In the course of this work, we may incidentally receive health information, for example, through anonymised case discussions, workforce health disclosures relevant to fitness for duty, or information referenced during a session or consulting engagement. Where this occurs, the Health Records Act 2001 (Vic) applies to that information in addition to the Privacy Act.

Health information we hold is used only for the purpose for which it was provided, or a directly related purpose you would reasonably expect; not disclosed to any other party without your consent, except where required or permitted by law; and stored and handled in accordance with the Health Privacy Principles set out in the Health Records Act 2001 (Vic).

We ask clients engaging our services not to share identifiable health information about clients, residents or staff with us unless it is necessary, and to de-identify case material wherever practicable before sharing it.

4. How we collect personal information

We collect personal information directly from you when you complete forms, communicate with us, book a call, download resources or engage our services. We may also collect information from publicly available sources, referrals, professional networks or business directories where it is reasonable and relevant to our business activities.

5. Anonymity and pseudonymity

Where it is lawful and practicable to do so, you may interact with us anonymously or using a pseudonym; for example, when making a general enquiry or downloading a publicly available resource. In most cases, however, we will need to identify you in order to respond to your enquiry, provide a personalised service recommendation, book a conversation, or deliver a service. If you choose not to identify yourself, we may not be able to assist with your request.

6. Unsolicited personal information

If we receive personal information that we did not request, for example, where it is included in an enquiry, attachment or referral without being asked for, we will assess whether we could have lawfully collected it. If we could not have, we will destroy or de-identify that information as soon as practicable, provided it is lawful and reasonable to do so. Otherwise, we will handle it in the same way as personal information we collect directly.

7. Why we collect personal information

We collect personal information to respond to enquiries; provide information about our services; send requested resources or downloads; book and manage appointments; assess whether our services are relevant to your organisation; prepare proposals or service recommendations; deliver workshops, programs or consulting services; manage client relationships; improve our website, services and communications; send relevant updates, resources or service information in accordance with section 9; and meet legal, regulatory, insurance and administrative obligations.

We only collect information that is reasonably necessary for our business activities.

8. Data quality

We take reasonable steps to ensure the personal information we collect, use or disclose is accurate, up-to-date, complete and relevant for the purpose for which it is held. You can help us by letting us know if your contact details or organisation information change.

9. Marketing communications and consent

We will only send you marketing communications such as service updates, resources or program information where we have your express consent or your consent can reasonably be inferred in accordance with the Spam Act 2003.

Express consent

Where you complete a form on our website to submit an enquiry, download a resource, book a call or subscribe to updates, you will be asked to confirm consent to receive related communications from Sangasure. You may withdraw this consent at any time.

Inferred consent

We may infer consent to send you a commercial electronic message where you have an existing business or client relationship with Sangasure and the message relates to that relationship; you have published your business email address in a context that does not state you do not wish to receive unsolicited messages, and the message is relevant to your professional role; or you have otherwise indicated, expressly or by your conduct, that you consent to receiving the message.

Your right to opt out

Every marketing communication we send includes a functional unsubscribe facility. You can also opt out at any time by contacting us directly. We will action an unsubscribe or do-not-contact request within five business days, and we will not send further marketing communications to you after that point. This section does not limit our ability to send you transactional or service-related communications necessary to deliver a service you have engaged us for.

10. Disclosure of personal information

We may disclose personal information to trusted third parties where reasonably necessary for our business operations, including website hosting providers, CRM and email marketing platforms, appointment booking tools, cloud storage providers, professional advisers such as accountants, lawyers or insurers, contractors, consultants or service providers assisting Sangasure, and regulatory bodies or authorities where required by law.

We do not sell personal information. Where we use third-party service providers, we take reasonable steps to ensure they handle personal information appropriately, including through contractual obligations to protect that information and use it only for the purpose it was provided.

11. Overseas disclosure

Some technology providers we use may store or process personal information outside Australia. This may include website hosting providers, email marketing platforms, CRM systems, cloud storage providers or analytics tools, which may store data in jurisdictions including the United States or other countries where our service providers operate or host data.

Before disclosing personal information to an overseas recipient, we take reasonable steps to ensure that recipient does not breach the Australian Privacy Principles in relation to that information. Under APP 8, Sangasure remains accountable for how an overseas recipient handles personal information we disclose to them, except where an exception under the Privacy Act applies. We select overseas service providers with appropriate privacy, security and contractual data handling commitments, and we review these arrangements periodically.

12. Cookies and website analytics

Our website may use cookies, analytics tools or similar technologies to understand website traffic, improve user experience and measure engagement. Cookies may collect information such as browser type, device details, pages visited, time spent on the website and referral sources. You can manage or disable cookies through your browser settings. Some website features may not function properly if cookies are disabled.

13. Storage and security

We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification or disclosure. This may include secure systems, password protection, access controls, cloud storage safeguards and internal procedures. No method of electronic transmission or storage is completely secure. We cannot guarantee absolute security, but we take reasonable precautions to protect the information we hold.

14. Notifiable data breaches

If Sangasure becomes aware of an eligible data breach, an unauthorised access, disclosure or loss of personal information that is likely to result in serious harm to an affected individual, we will assess the breach and, where required under Part IIIC of the Privacy Act 1988, notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as soon as practicable.

15. Data retention and destruction

We only keep personal information for as long as it is needed for the purpose it was collected, or as required by law. Standard retention periods include: general enquiries that do not progress to a client relationship, 12 months from last contact; client engagement and service delivery records, 7 years from the end of the engagement; outreach and prospect contact data (CRM), 24 months from last contact unless an active relationship exists; workshop, session and program attendance records, 7 years from the date of attendance; website analytics and technical data, as set by the relevant analytics platform, typically up to 26 months; health information received incidentally, no longer than necessary for the purpose it was provided, and in any case no longer than 7 years.

Where it is not appropriate to destroy information outright, for example where it forms part of a record we are required to retain, we will de-identify it instead. These periods may be extended where required for an active legal, regulatory or insurance matter.

16. Accessing or correcting your information

You may request access to the personal information we hold about you. You may also ask us to correct information that is inaccurate, incomplete or out of date.

Contact: info@sangasure.com.au

We will respond to access and correction requests within 30 days. We may need to verify your identity before responding. We may refuse a request in limited circumstances permitted under the Privacy Act. If we refuse, we will explain why and tell you how you may complain about that refusal. If we disagree with a correction you have requested, you may ask us to associate a statement with the information noting that you believe it to be inaccurate, incomplete, out of date, misleading or irrelevant.

17. Complaints

If you have a concern about how we have handled your personal information, please contact us first so we can review and respond to the issue.

Email: info@sangasure.com.au

We will acknowledge your complaint within 5 business days and aim to provide a substantive response within 30 days. If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au, or by phone on 1300 363 992.

18. Links to other websites

Our website may contain links to third-party websites, tools or platforms. We are not responsible for the privacy practices, content or security of external websites. You should review the privacy policies of any third-party sites you visit.

19. Telemarketing and the Do Not Call Register

Where we make telemarketing calls, we comply with the Do Not Call Register Act 2006. We do not call numbers listed on the Do Not Call Register unless an exemption applies, such as an existing business relationship with the called party or your express consent to be contacted.

20. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. The updated version will be published on this website with a revised effective date. Where a change materially affects how we handle your personal information, we will take reasonable steps to notify active contacts by email in addition to publishing the update. Your continued use of the website after changes are published means you accept the updated Privacy Policy.
